Offer DescriptionThe research proposes to delve into the concept of judicial error.
On this point, the Constitution, in Article 24 paragraph 4, has delegated to the legislature the determination of the conditions and ways to guarantee a form of reparation.
In doctrine and jurisprudence, however, a clear and unambiguous notion of judicial error has not yet been clearly identified.
In attempting to identify it, it will first be necessary to dwell on the concept of reparation.
By it, the legislator intends to refer both to the set of instruments aimed at removing the error and to the institution used to compensate the recipient of the injustice for the consequences suffered in the face of its occurrence.
By reconstructing the origins and developments of the normative concept of judicial error, as well as the individual forms of reparation provided by the legislator, the research will attempt to highlight the criticalities and aporias that the current codified discipline presents.
