**Job Description**:
The Clearpay EU branch Legal & Compliance Manager will manage all the compliance & legal issues, ensure the structure is compliant and will cover risk management governed by local regulations, internal policies, and group procedures.
You will report directly to the EU Head of Legal & Compliance, and will work with the different EU Heads of Legal and Compliance, to be 100% coordinated regarding policies, procedures and decisions.
You Will:
- Handle legal negotiations with potential merchants and partners to get agreements, taking care of Clearpay's interest and being always aligned with the commercial needs
- Litigate and provide legal support and advice to upper management on relevant legal issues
- Ensure compliance with the internal controls, statutory regulations, and other formalities (e.g, Labor, Tax, and Corporate)
- Draft legal documents such as contracts, statements, agreements
- Keep up with current changes on all relevant areas of laws and contributing to the enhancement of the knowledge base of our legal function
- Manage compliance monitoring program and ensure compliance and risks controls are in place
- Conduct employee compliance/AML training
- Ensure all compliance owned registers are updated (e.g., PEP register, complaints, gifts and entertainment, sanctions, breaches )
- Review and investigate Suspicious Activity Reports
- Recommend any changes to operating procedures considering regulation or procedural changes and contribute to the development of new operating procedures
- Be the first contact on compliance issues for the branch and provide support to the Clearpay EU General Counsel in the Italian jurisdiction
- Declarant/Consultant to the Local Financial Institution Authorities (ACPR/ TRACFIN/ UIF)
- Be the contact between our company and GDPR Supervisory Authorities (CNIL/Garante Della Privacy)
- Monitor performance and provide advice on the impact of data protection efforts
- Work with all consumer's request (e.g., use of data, right to erase)
**Qualifications**:
You Have:
- 6+ years of demonstrated experience in similar positions as In-House lawyer, in a Compliance Department or in a Lawyers' Office; experience in the financial sector is especially valuable
- Good knowledge about the Italian and UE regulations about consumer credit, payment services, AML and data protection
- Very good level of English, written and spoken
- Work in an international environment, liaising directly with people in different countries and with a different cultural background
- Work as part of a team, creating synergies and a very good atmosphere and collaborating with colleagues in solving daily problems
- Clear business orientation, focusing not on the existence of the problems, but on the possible solutions
