2. Safety notice
Please note when applying by email that access to the data byunauthorized third parties cannot be ruled out. To communicate securelywith us, please use our online application portal. As an alternativesecure transmission option, We offer the option to send us yourapplication documents by mail. In the case of application by mail, Wewill scan your application documents if necessary to transfer them toour electronic application system.
3. Which data of yours will We process? And for what purposes?
We process the data that you sent to us as part of your application tocheck your suitability for the position (or possibly other openpositions in our Companies) and to carry out the application process.
4. What is the legal basis for this?
The legal basis for processing your personal data in the applicationprocess is article 6 GDPR para. 1 lit. b) (contract initiation), lit. a)(consent, e.g. for longer storage or if you provide us with databelonging to special categories of personal data) as well as article 88in conjunction with § 26 para. 1 BDSG (German federal privacy law, newversion) (the data may be processed if this is necessary in connectionwith the decision to establish an employment relationship).
If the data is necessary for legal prosecution after the applicationprocess is complete, data processing may be carried out based on therequirements of article 6 GDPR, in particular to safeguard legitimateinterests pursuant to article 6 para. 1 lit. f) GDPR. Our interest thenlies in the assertion or defense of claims.
5. For how long is the data stored?
If we have not agreed on a longer period via your granted consent, Wewill delete your application documents after a maximum of six monthsafter the application process is completed. This applies equally towritten and electronic applications.
In the event that you agreed to your application data being transferredto our applicant pool and thus forwarded within the group of Companiesand to a long-term storage of your personal data, then We will transferyour data to our applicant pool. The data will be deleted there after amaximum of two years.
If you have been awarded a job as part of the application process, thedata will be transferred from the applicant data system to our personnelinformation system.
6. To which recipients is the data forwarded?
If an advertised job for which you have applied at a certain Company ofthe Loacker Group is not awarded to you, your application data will bepassed on within the group of Companies (if you consent) to check yoursuitability for other job offers.
We use a specialized software provider for the application process thatmanages the application web portal. This provider works as a serviceprovider for us and may also receive knowledge of your personal data inthe context of maintaining and caring for the systems. We have concludeda so-called data processing agreement with this provider, which ensuresthat the data processing occurs reliably and so that your data isprotected.
Your data may also be processed by external service providers (e.g.employment agencies) for the purposes named in section 3. These serviceproviders have concluded a data processing agreement with us, but mayalso work as independent data controllers. By request, We will provideyou with the current directory of the data processors.
Your application data will be inspected by the human resourcesdepartment after your application is received. Suitable applicationswill then be internally forwarded to the department heads for therespective open position. The further course of action will then becoordinated. Generally, only the people in the Company who need yourdata for the proper course of our application process are givenaccess.
Your personal data will not be distributed or published.
7. Where is the data processed?
The data is only processed in data centers in the European Union and the United Kingdom. Standard contractual clauses have been signed between the exporter (company within the EU) and the importer (UK-based partner company appointed as data processor), which are based on the "COMMISSION DECISION of 5 February 2010 on standard contractual clauses for the transfer of personal data to processors established in third countries under Directive 95/46/EC of the European Parliament and of the Council (notified under document C(2010) 593)".
8. Your rights as a "data subject" as per article 15 ff. GDPR
Your right to object to processing: Of course, it is possible towithdraw an application. In this case, We will immediately delete alldata associated with the application, unless this is contrary to aretention period prescribed by law.
You have the right to be informed about the personal data We processabout you.
In addition, you have the right to rectification, erasure or restrictionof processing to the extent permitted by law. The same applies to theright to data portability.
9. Our data protection officers
